Guarantees are not common in Germany. Therefor we do not guarantee our puppies sold as pet-quality but only those sold as breeding-quality. If no contract was signed, the pup is automatically sold on a pet-contract. For an adult GSD sold with standing ears, complete teeth and a-stamp, there are no further guarantees.

The seller assures that the sold German Shepherd is to be registered in the SV breed book. A copy of the litter-registration-form will be attached to the vaccination reports. The pedigree will be sent to the buyer, as soon as the seller receives it from the SV in Germany which usually takes about 4 months after the dog has been tatooed.

Your dog is not a lifeless animal, but a creature that needs affection, attention and particular care. As you made sure the animal seemed to be healthy and certainly will accustom to it's new surroundings quickly.

The following conditions are agreed upon in the animals interest:

  • 1. Both buyer and seller agree that the said animal is in good health as of the above date of purchase. No obvious or hidden defects or disease are known to the seller. The purchaser renounces to assert any claims later according to development of anatomy or character, or to defects or disease (acquired or inherited) making their appearance or being established later. We do not warranty the temperament of our puppies. Temperament is determined by genetics and environment. Too often, nice puppies develop temperament problems as a result of the way they were raised. We have no control over environment.
  • 2. Upon purchase, the buyer assumes all responsibility for the care, medical needs, medical expenses and welfare for the ownership period and/or lifetime of this puppy.
  • 3. There are no further implied or intended warranties or guarantees.
  • 4. Any legal disputes must be settled in seller's country.
  • 5. I the buyer, understand and do agree to all the terms in this contract.

  • 3. The seller guarantees the following:
    • a: The pup’s ears are warranted to stand. If there is concern regarding the ears standing when teething is finished, contact TopGSD. A pup will not be replaced for soft ears unless TopGSD was informed and has documented what was done. We do not have ear problems in our dogs. If a GSD owner takes the necessary precautions to tape weak ears 99.9% of the time they will stand. It is entirely possible to have a dog whose ears would have stood if they had been taped. But they did not stand because the owner has not done his or her share in making sure the ears were properly taken care of.
      Customers should know that ears may come up and then go back down when the dog begins teething. If this happens the ears will ALWAYS come back up after teething.
      If a puppy is replaced because of not standing ears it will not be done under the age of 9 months.
    • b: The pup’s teeth are warranted to be complete at 1 year of age. If one tooth is missing the dog needs to be xrayed. X-rays and a certificate of the vet which tooth is missing needs to be send to TopGSD in Germany.
    • c: The pup’s hips are warranted to be a-stamped at 1 year of age. This warranty expires when the pup is 15 months old. This means the owner has a 3 month window to have the pup x-rayed and ask OFA for a preliminary opinion. If OFA does not expect this dog to be OFA-certified the owner needs to send in the needed xrays to United Schutzhund Clubs of America (U.S.A.) and ask for the German a-stamp. The pup can only be replaced if SV in Germany refuses the a-stamp.
    It is important to understand that there is a possibility that a puppy from a reputable kennel in Germany can develop hip dysplasia, even though every dog they breed has had it's hips x-rayed and has good hips. But this does not change the fact that German Shepherds all have the ability to produce an occasional bad hips in their offspring.
    The only way to get a 100% guarantee that a dog does not have bad hips is to purchase an adult dog and have the hips x-rayed before the purchase.
    Puppies can develop bad hips as a result of over feeding or over exercising. It's the owner's responsibility to keep the puppies thin throughout their first year of life. This is very important. Pups should be fed with a large-breed-puppy food and be taken off puppy food at 6 months of age to slow the growth. A close up photo of the dog must be taken with the date noted if a vet feels that a dog's hips are not good. We will also require a letter from the vet with the date and weight of the dog at the time of the x-ray. Once again there are owner responsibilities that need to be followed concerning the hips. Owners must keep their pups THIN. No German Shepherd breeder can produce good hips 100% of the time, but we do our part by only breeding dogs with certified hips in all 4 generations behind the puppy. We expect the owners to follow through with their part by not over feeding or over exercising their pup.
  • 4. No dog will be replaced without TopGSD in Germany viewing a set of the x-rays. There is NO EXCEPTION to this policy as too many dogs with good hips have been replaced.
  • 5. If the dog is bred before 2 years of age -THIS WARRANTY IS VOID. This does not mean you cannot breed before 2 years. It just means you need to x-ray and be sure of the hips before you breed. We will not replace a dog for bad hips if it has been bred.
  • 6. If a pup is to be replaced because of not standing ears or missing teeth it MUST BE RETURNED TO TopGSD IN GERMANY AT THE OWNERS EXPENSE. THE BUYER ALSO IS RESPONSIBLE FOR THE SHIPPING COSTS OF THE REPLACING PUPPY TO THE USA.
    If a pup is to be replaced because of hip dysplasia the buyer has the opportunity to send the dog back to Germany on his expenses or to keep the dog as pet and sent a proof of spaying/neutering to TopGSD. THE BUYER STILL IS RESPONSIBLE FOR THE SHIPPING COSTS OF THE REPLACING PUPPY TO THE USA.
    THERE WILL BE NO EXCEPTIONS TO THIS.
    The replacement puppy will be selected by TopGSD in Germany and be of equal or better quality.
  • 7. If a replacement puppy is given to the buyer, the seller is no longer obligated to the buyer. The replacement puppy does not have a replacement guarantee. The buyer can keep or sell the replacement puppy.
  • 8. Our warranty is a replacement puppy warranty and not a money back warranty. We do not refund money on replacement dogs. There are no exceptions to this.
  • 9. All puppies will be registered SV in Germany. The puppies will all be tattooed in the right ear. You can register them with AKC. Therefore you will need a special certificate from SV certifying you are the owner of the pup. They are asking for $20 for that letter. TopGSD can help to get that certificate. Please mark one of the following possibilities:

  • 10. There are no other implied or intended warranties or guarantees.
  • 11. Any legal disputes must be settled in seller's country.
